Bollywood actor Shilpa Shetty and her husband, businessman Raj Kundra, have approached the Bombay High Court to challenge eviction notices issued by the Enforcement Directorate (ED). The notices, dated September 27, 2024, directed them to vacate their residential property in Mumbai’s Juhu area and a farmhouse in Pune within ten days. These actions are linked to a money laundering case involving an alleged Bitcoin fraud valued at ₹6,600 crore.
The Legal Challenge
The couple’s plea disputes the ED’s actions, terming the eviction notices arbitrary and illegal. They argue that their properties, purchased through legitimate means, have no connection to the alleged crimes. The High Court has currently stayed the eviction orders, allowing the couple time to contest the provisional attachment of their properties, valued at ₹97.79 crore, by the ED.
The case stems from allegations of a Ponzi cryptocurrency scheme, though neither Shetty nor Kundra is listed as an accused. Kundra, however, has been summoned multiple times for questioning during the investigation. Their legal team has emphasized that eviction cannot occur without a conviction in such cases.
Implications and Next Steps
The High Court has issued notices to the ED, and the matter is scheduled for further hearings. The couple is seeking relief to retain possession of their properties and protect their family’s residence of over two decades. The decision could set a precedent in cases involving provisional property attachment in money laundering investigations.
This legal battle highlights the complexities of navigating high-profile investigations where property rights and allegations of fraud intersect.
